公共安全视频管理不应无视个人诉求–公益–人民网   公共安全视频资料既是一种公共信息,也是一种政府信息,因此不能无视公众查看的诉求。   ———————————————————-   广州市日前修订了已实施9年的《广州市公共安全视频系统管理规定》。其中,引起关注的是新增设的“紧急查看权”规定:个人因人身、财产等权利遭受侵害,情况紧急的,可以查看公共安全视频系统相关信息,但不得复制和调取。公共安全视频系统使用单位应当在登记查看人员身份信息后给予积极配合。(《人民日报》9月7日 )   公共安全视频系统在各地建立以后,在打击犯罪、治安防范、社会管理、服务民生等方面发挥了积极作用。在缺乏全国性视频监控管理法规的情况下,广州市以地方政府规章的形式为此建制立规,无疑是一种积极探索。难能可贵的是,在明确视频监控的安装主体、安装程序、资料管理等内容的同时,广州新规通过“紧急查看权”兼顾了个人的权利诉求。   诚然,公共安全视频系统所记录的信息,具有较强的隐私性和保密性。不过,因此拒绝一切个人查看监控的请求,未免有些不近人情。倘若因此而加重个人损失,更难免令人心生怨言。现实生活中,丢失贵重物品、小孩被拐、老人走丢等情况时有发生,允许个人查看监控能够更便捷地解决问题。   公共安全视频系统就是为公共管理服务的,只不过其服务对象往往局限于执法者,而没能惠及普通市民。究其原因,在于没有明确法律规范界定个人是否有权查看监控。由此造成的后果是,一些原本可以控制的事态持续升级,某些可以挽回的损失被不断放大。在兼顾公共安全与公民隐私的同时,对那些突遭变故者“网开一面”,既体现了制度人性化的一面,同时也是公共安全视频系统服务职能的一种直接体现。   《广州市公共安全视频系统管理规定》以法律形式赋予了市民查看监控的权利。当然,任何权利都是有边界的,就查看监控而言,市民的查阅权仅限于“情况紧急”,还必须进行身份信息登记,由此避免了滥用查阅权。此后,公安机关不能以“不对个人公开”为由推脱责任,这本身也是破除执法神秘化的有力举措。   公共安全视频资料既是一种公共信息,也是一种政府信息,因此不能无视公众查看的诉求。不过,允许个人查阅必然会增加公安机关的工作压力。要想真正落实善政,仍须制订细则、明确责任。   作为一种新生事物,“紧急查看权”仍有待于补充完善。在人性化执法已成为共识的时候,城市管理者应努力让公共安全视频监控更加人性化。基于便民利民的考虑,如果公共安全视频监控能多为公众打开方便之门,不仅公共安全能够更加有保障,“全网共享”的目标也更加容易落到实处。地方的积极探索实践,也有利于在国家层面针对公共安全视频建立统一规范。 (责编:史雅乔、蒋琪)相关的主题文章:
